Veterans' Benefits Attorney in Manistee, MI
Over 30 Years of Elder Law Experience to Support Veterans
What Is Aid And Attendance?
Manistee runs deep with the kind of quiet, hardworking community that has sent generation after generation into military service. For the veterans and surviving spouses who have built their lives here, finding quality care that does not drain a lifetime of savings is one of the most pressing challenges families face. Aid and Attendance, or A&A, is a monthly VA pension benefit that can make a meaningful difference in how those costs are managed. Many Manistee families who are already paying for care at home or through a local facility are eligible for this benefit and simply do not know it exists. As of 2025, the maximum monthly amounts are:
Married Couple: $3,740
(two veterans who need A&A)
Veteran and Spouse or Dependent: $2,795
Single Veteran: $2,538
Surviving Spouse of Veteran: $1,515
The Law Offices of David E. Waterstradt has worked with veterans across northern West Michigan for over 30 years and regularly helps Manistee families pursue the benefits they have earned.
How the VA Determines A&A Eligibility
The VA evaluates every A&A claim across four areas: disability, service, assets, and income. You establish eligibility through the Veterans Application for Pension or Compensation, filed directly with the VA and supported by documentation that addresses each requirement.
Disability Requirement
A veteran must be 65 or older and require another person’s assistance to manage basic daily functions such as eating, bathing, dressing, or toileting. Significant vision loss and being bedridden are also qualifying conditions. Care can be provided by an assisted living facility, a home health aide, or a qualifying family member or cohabitant other than a spouse, as long as a licensed health care professional has recommended the level of care being received. A written Care Contract is also required between the caregiver and the person receiving care. It must describe the services to be provided and set a rate of compensation that reflects what comparable care costs in the Manistee community. Our office prepares these contracts for clients throughout the area so the application is complete and nothing causes unnecessary delays.
Service Requirements
Overseas deployment and combat service are not factors in A&A eligibility. A veteran needs an honorable discharge and at least 90 days of active-duty service, with at least one day falling within a congressionally declared war period. Surviving spouses of veterans who satisfy these requirements may also qualify on their own.

Why Manistee Families Benefit From a Coordinated Approach
Northern West Michigan families often carry a different mix of assets than those closer to urban centers. Seasonal property, farmland, and timber holdings are common in Manistee, and each one requires careful analysis before any veterans benefits planning begins. At the same time, the distance from major legal centers makes it all the more important to work with an attorney who can handle the full scope of what a veteran’s family needs in one place. A durable power of attorney and a patient advocate designation under Michigan law are just as critical as the A&A application itself, and Michigan Medicaid planning becomes increasingly relevant as care needs grow. The Law Offices of David E. Waterstradt brings all of these pieces together for Manistee families, treating veterans benefits not as a standalone transaction but as part of a complete and coordinated long-term care plan.
Why Experienced Legal Help Matters for VA Aid and Attendance
The A&A application process is detailed, and the intersection of VA pension rules with Michigan Medicaid planning is not something families should navigate without experienced legal counsel. Our office handles the full process from the initial eligibility review through document preparation and filing, and we work with families across the full breadth of Manistee County and the surrounding region. Benefits are paid retroactively to the month following the month the application is filed, so families who have been putting this off are leaving real money on the table.
